Trirex – Terms and Conditions

Important Risk Disclaimer (Forex & Automated Trading)

Our company provides software and trading robots ("Bots") that can be used with third-party trading platforms such as MetaTrader. Trading leveraged products such as forex and CFDs involves significant risk and may result in substantial losses, including loss of your entire trading capital. You are responsible for all trading decisions, configuration choices, and trades executed on your account. Only trade with money you can afford to lose.

We do not provide financial, investment, tax or legal advice. Nothing on the Platform, in Discord, in guides, or in any communications constitutes a recommendation tailored to your personal circumstances. Loss statistic (source): EU regulators have reported that a significant majority (often between 74%–89%) of retail accounts lose money when trading CFDs. (Your broker/provider will often display a provider-specific loss percentage as required by local product-intervention rules.)

1. Acceptance of Terms

By registering and using the Platform, you agree to be bound by this agreement. If you do not agree, you must not use the Platform and must stop using the service immediately. We may modify this agreement from time to time, and such modification will be effective when posted on the Website. You agree to be bound by any modifications when you use Trirex after they are posted. Please review these Terms regularly. Use of the Platform is only available to persons over the age of 18. To open an account through a forex broker, you must generally be at least 18 years old. You represent and warrant that all registration information you submit is accurate and truthful and that your use of the Platform does not violate applicable law or regulation. Trirex may, in its sole discretion, refuse to offer services to any user and change its eligibility criteria at any time, where permitted by law. The Platform may only be used in compliance with these Terms and all applicable local, national and international laws, rules and regulations. By registering and using the Platform, you represent and warrant that you have the full right, power and authority to enter into this agreement and to fully perform your obligations hereunder.

3. Account

To use the Platform's functionalities, you must create an account. You may be able to register and log in through your Google account. You are responsible for maintaining the confidentiality of your password and account information and for all activities that occur under your account. You agree to (a) notify Trirex immediately of any unauthorized use or breach of security, and (b) log out at the end of each session. You may not use another user's account without authorization. Trirex will not be liable for loss or damage arising from your failure to comply with these obligations. You may cancel your account at any time by following instructions on the Platform or contacting us. Account termination results in deletion of the account and personal data as described in our Privacy Policy (subject to legal retention obligations). Trirex reserves the right to terminate your account or access immediately, with or without notice, and without liability, if Trirex reasonably believes you have breached these Terms, provided false or misleading information, or interfered with the use of the Platform by others.

4. Notifications and Newsletter

By providing Trirex with your email address, you consent to our use of your email address to send notices about Trirex and service messages. We may also send updates, news and special content. You can opt out of marketing emails using the unsubscribe option or by contacting us. Opting out may prevent you from receiving non-essential updates.

5. Plans

Our bots and platform access are sold as one-time purchases. When you buy, you agree to pay the price displayed at the time of purchase, so please check the price and what is included before buying. Every purchase is a one-time payment that includes lifetime access and updates for the product you buy — there are no subscriptions, recurring charges or renewals. We may change, discontinue or update our products and pricing at any time, but this does not affect access you have already paid for.

6. Payments

Purchases are completed manually through a private ticket in our Discord. After you place an order on our website we prepare it and give you an Order ID; you then open a purchase ticket in Discord, where we complete payment with you by Bank Transfer, PayPal, Revolut or Wise (the available methods may vary by location). Access is activated after we receive and confirm your payment. If your payment fails, is reversed, or is not received, we may suspend or terminate access until payment is completed. If you believe a charge is incorrect, you agree to contact us first at payment@trirexio.com and provide reasonable details so we can investigate and attempt to resolve the issue promptly. Nothing in these Terms limits your statutory rights (including the right to dispute a payment with your bank or payment provider). However, abusive, fraudulent or bad-faith disputes/chargebacks (e.g., claiming "unauthorized" after you used the service) will result in immediate suspension or termination of access, revocation of licenses/keys, and recovery of our reasonable costs of handling the dispute, where permitted by law. We are not required to provide or continue access to the services if payment has not been successfully completed or is later reversed.

7. Digital Content, Activation and Refunds (EU/NL-Aligned)

Trirex supplies digital content/services (software access, license keys, downloads, integrations, etc.). Because the service can be delivered immediately and can be used once activated:

• Activation / start of performance: Upon payment, we provide access and/or a license key and you may activate and use the digital service immediately.
• Withdrawal right (EU consumer rule) & your acknowledgment: Where EU consumer withdrawal rights apply, you acknowledge that once the supply of digital content/services begins with your prior express request and acknowledgment, the withdrawal right may be lost. By purchasing, you request immediate performance/delivery and acknowledge that you may lose your right of withdrawal once delivery/performance begins.
• No refunds after activation (your rule, legally framed): Once the product/service is activated or access has been provided and used, we do not offer refunds except where required by applicable law (for example, where the digital content is defective and we fail to fix it within a reasonable time).
• If something is broken: If the service does not function as promised due to our fault, you must contact us and allow us a reasonable opportunity to fix the issue. If we cannot remedy within a reasonable time, you may be entitled to a statutory remedy under applicable consumer law.

8. Not a Broker / No Custody / No Account Access

Trirex is not a broker, not a dealer, not an investment firm, and not a financial adviser.

• We do not hold client money or client assets.
• We do not open brokerage accounts for you.
• We do not have custody of your funds.
• Your trading account is held with your chosen third-party broker and is subject to that broker's terms, fees, execution quality, margin rules, and risk management policies.
• You are solely responsible for choosing your broker, ensuring regulatory compliance in your jurisdiction, and ensuring your use of the software is lawful.

9. Disclaimer (Forex / CFDs / Automated Execution)

The following disclaimer applies to all services offered by Trirex, including automated software used in forex/CFD markets. Trirex does not guarantee profits or benefits from the use of any service. Trading in forex/CFDs is risky and can involve substantial losses. As these are automated tools, trades may open/close without manual intervention depending on your configuration and market conditions. The indicative prices, charts or performance figures (if any) shown on our Platform or community channels may be delayed, approximate, or derived from third-party sources. They are informational only and may not reflect actual execution prices, spreads, commissions or slippage at your broker. Do not trade based solely on information provided through the Platform, Discord, or support messages. Past performance is not indicative of future results. You are responsible for monitoring margin and available funds and for stopping/pausing the Bot or closing positions when appropriate. You can start, stop, or pause the Bot at any time; you can also close orders yourself or open additional ones, and you accept the risks of doing so. The software is a technical tool that executes user-defined configurations and market signals and does not determine or control market outcomes.

10. Third-Party Materials

"Third-Party Materials" means any content, images, videos, texts or other material owned by a third party. Such materials are subject to the applicable third-party terms and licenses and may only be used as permitted.

11. License to Use the Platform

Trirex gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the Platform and related software as part of the services. You may not copy, modify, distribute, sell, lease, sublicense, or reverse engineer any part of the services or included software, except where laws prohibit those restrictions or with our written permission. You agree not to use the Platform negligently, fraudulently, or unlawfully, and not to damage the image, interests, or rights of Trirex or third parties. Trirex may terminate your access immediately if you violate these Terms. Using any form of copy-trader to copy a live account to other live accounts (or demo to live) with our software may result in termination of your license key and access.

12. Copyright

All materials on Trirex (names, logos, trademarks, images, text, graphics, videos, photographs, software, etc.) are protected by intellectual property laws and are owned/controlled by Trirex or licensors. Materials are made available for limited, personal use only. Any unauthorized use is prohibited.

13. Copyright Complaints

If you believe in good faith that any material on the Website infringes your copyright or other intellectual property rights, please submit a request via our contact details including: identification of the right; location of the material; your contact details; a good faith statement; an accuracy statement; and your signature.

14. User Content

If you provide content through the Platform (where applicable), you retain your rights in that content. You grant Trirex a worldwide, non-exclusive, royalty-free license to host, store, display and process the content solely to operate the Platform and provide the services. You are responsible for the legality and consequences of your content.

15. Personal Data

Personal data is processed in accordance with our Privacy Policy.

16. Prohibited Activities

You agree not to:

• Use the Platform outside the scope permitted by these Terms;
• Scrape, spider, or automate access without permission;
• Bypass security, interfere with features, or impose unreasonable load;
• Frame/mirror the Platform;
• Reverse engineer, decompile or disassemble the software (except where legally permitted);
• Circumvent security-related features.

17. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We do not promise uninterrupted or error-free service. Links to third-party websites are provided for convenience; we are not responsible for their content or services. Nothing in these Terms excludes or limits warranties that cannot be excluded under applicable law.

18. Limitation of Liability

To the maximum extent permitted by law, Trirex is not liable for indirect or consequential losses, loss of profits, loss of data, trading losses, or damages arising from your use of (or inability to use) the Platform, including losses caused by market movements, leverage, broker execution, spreads, slippage, margin calls, or your configuration choices. However, nothing in these Terms limits or excludes liability for:

• intent (opzet) or gross negligence (grove schuld) where exclusion is not permitted, or
• any liability that cannot be excluded under Dutch/EU law (including certain consumer rights).

Trirex is not liable for failures caused by events beyond reasonable control (force majeure), including outages, communications failures, fire, flood, war, or acts of God.

19. Electronic Communications

No responsibility is accepted for failed, partial or garbled transmissions, internet accessibility issues, third-party network failures, or unauthorized human acts outside our reasonable control.

20. Indemnification

You agree to defend and indemnify Trirex from and against claims, losses, damages, fines, penalties, and expenses (including reasonable legal and accounting fees) arising from:

• your breach of these Terms;
• your violation of law or third-party rights;
• your misuse of the Platform.

21. Changes and Termination

We may change the Platform and these Terms at any time. Continued use constitutes acceptance of changes. We may terminate this agreement with you by notifying you (including by email) or immediately where necessary (e.g., serious breach).

22. Assignment

You may not transfer or assign this agreement. Trirex may assign this agreement without restriction, subject to applicable law.

23. Integration Clause

These Terms, together with the Privacy Policy and other legal notices published by Trirex, constitute the entire agreement between you and Trirex regarding the Platform.

24. Disputes, Governing Law, and Courts

These Terms are governed by the laws of the Netherlands. If you have a dispute, you agree to contact us first and attempt to resolve it informally. If we cannot resolve it, disputes shall be submitted to the competent courts in the Netherlands, unless mandatory consumer protection rules give you the right to bring proceedings in your country of residence.

25. Discord Community and 1-on-1 Support

Trirex may provide access to Discord and may offer 1-on-1 support through Discord or other channels. We do not guarantee response times, availability, or resolution times for any support request.

• 1-on-1 support is provided at our discretion and is not mandatory.
• We may refuse, limit, or stop 1-on-1 support for users who are abusive, disrespectful, harassing, threatening, or who violate community rules.
• If 1-on-1 support is refused or discontinued, you can still use the Platform and our documentation/guides (where access is available), and participate in general community discussions subject to rules.
• Trirex reserves the right to remove, suspend, or permanently revoke access to the Discord community at any time, with or without prior notice, if a user violates community rules or engages in behavior deemed abusive, disrespectful, misleading, or harmful to Trirex or other users.
• This includes, but is not limited to: harassment, threats, spam, spreading false information, attempting to damage the reputation of Trirex, or disruptive behavior within the community.
• Removal from Discord or community platforms does NOT entitle the user to any refund, compensation, or continued support.
• Trirex also reserves the right to suspend or revoke access to software, licenses, or services in cases of serious violations, fraud, abuse, or chargebacks.
• Licenses are personal and non-transferable. Sharing, reselling, or distributing access may result in immediate termination without refund.
